
Joe Grits, serving time, seeks release on appeal.
In July, content creator Joseph “Joe Grits” Thompson was sentenced to three years in prison by a state judge following his conviction for posting social media threats against a police officer involving the shooting death of his friend Dyshan Best.
One caption declared “somebody gotta die, somebody should die with a badge on.”
Connecticut’s inspector general found that the fatal shooting was justified because Best brandished a gun as he ran from police after a traffic stop.
At trial Grits opted to defend himself rather than securing a defense attorney or the pro bono work of a public defender to mitigate prison exposure. During sentencing the judge ordered Grits’s immediate incarceration rather than keeping him out on appeal.
Now in prison, Grits has retained the services of defense attorney Alexander Taubes who provided an update about his client’s legal status on Facebook.
Today the Connecticut Appellate Court reversed the manslaughter conviction of Robert Fisher, an 80-year-old former Litchfield lawyer.
Why? Because while his trial was underway, the judge presiding over it had a pending application to become Inspector General — a supervisory prosecutor position inside the very agency, the Division of Criminal Justice, that was prosecuting him. He didn’t disclose it until well after the guilty verdict. The Appellate Court held that his impartiality could reasonably be questioned, and threw the conviction out.
But here is the tragedy buried in this story: Mr. Fisher was sentenced to two and a half years, no appeal bond was granted, and he has been sitting in prison ever since — while the appeal that just vindicated him slowly worked its way through the system. He “won.” And no court on earth can give him back the time he already served on a conviction that never should have stood. If the appeal had taken just a little longer, he would have finished his entire sentence before anyone ever ruled on it.
I know this tragedy up close, because my client Joseph “Joe Grits” Thompson is living it right now. On July 27, Joe was sentenced in Bridgeport to an effective three years to serve — for social media posts that we contend are protected political and artistic expression under the First Amendment. We asked that he remain free while the appellate courts decide whether his conviction can stand. The court said no, from the bench. We have now taken the fight to the Appellate Court, petitioning for his release pending appeal.
Appeals take time — often a year or two, sometimes more. With a three-year sentence, a person can serve most or all of their time before any court ever decides whether the conviction was lawful in the first place. An appeal you can only win after the punishment is complete is not a right. It’s a meaningless formality. This treatment of appeal bonds emerging in Connecticut is an insult to anyone who cares about the integrity of our judicial process and our legal heritage.
Connecticut needs a rebuttable presumption of appellate bonds in lower-sentence cases. We should amend the Practice Book. If the sentence is short and the appeal is taken in good faith, release should be the default — unless the State can prove the person is a danger or a flight risk with real evidence. The current system is wrong and unjust.
Robert Fisher’s reversal should be a warning to all of us. And Joe Grits should be home while his appeal is heard.


This seems so unnecessary. I mean, you would have to think a lawyer would have gotten him off. Not sure what he was thinking to defend himself. Though we will never know.
That being said. You would also have to think that politics plays a role, to say the least. As for a just judgment in the court system and law enforcement, we know justice, right, and wrong is very subjective, to say the least. Would you say BPD, judicial system, Court, Appellate Court, CT Supreme Court, Comp Court?

Alexander Taubes, here’s the flip side of the coin. The Grits trial/case was straight and simple only complicated by the dumb ass lawyer who represented Joe Grits.
You sound like you guarantee Joe Grits will prevail in his appeal. I bet he will not! It’s about time Joe man-up to the consequences of his words, action, and decision.
The flip-side: Let’s say poor Joe’s appeal doesn’t materialize after having served 2 years, he would have a few more months to go home as opposed to having to go back to serve time he could have already finished serving. Why delay the inevitable? Besides, winter is coming.

Or is he.
Please, Pencil Box, that statement alone speaks volumes. While it was a true statement, Joe didn’t make his case it was a true, viable, real threat.
Being a witness beyond the headlines and sound bites, what was the plea deal Joe passed on?
BTW, how do you know Joe is posting from Jail, or is he? I mean, you can’t use social media in prison, right? Generally, when someone hacks your social media account, you know, make it known to your followers, no?
Also, it is not wise to suggest to the jury you didn’t make the post on one hand and claim protected free speech, on the other, from a lawyering standpoint. JS

Joseph Thompson case not one isolated incident to me. I was there (not nearly as vocal or visible as Mr. Thomson) on the streets during some of the protests and inside the courtroom during the trial up until jury deliberations. I have quite an interest in the first amendment and I am quite unwilling to rely on partial reporting by the media. I attended the trial up until deliberations began. The more I witnessed first hand, the more evident it became that this was not an aberration, but a pattern taking place across America. Especially in Bridgeport.

I won’t deny the racial inequality and injustice of our corrupted legal system. However, “disingenuous” comes to mind when I read your statement on the matter.
Like socialism selling point, “we are all in this together.” Do you feel like you are selling anti-whiteism?
I mean, you seemed to leave out a few issues, like, to my understanding, the police were called about gunplay and pulled over the vehicle in question. As well as the cop questioning Best about why they were called, and the questionable object that was in his hand as he pointed at the officer as he was running away.

For starters, you have to ask what was the plea deal Joe G rejected, and how much of Joe G’s guilty verdict rests on his defending himself.

No my case was different and I won’t speak on it on the advice of council til things wrap up. The Best killing certainly was a case of race. As Best lie there bleeding out with gunshot wounds to his BACK an ambulance meant for the African American Mr. Best was comandeered by Caucasian female Erin Perrota because she was having a so called panic attack.
Putting a hysterical white female on an ambulance as a black man lay dying of gunshot wounds certainly reeks of racism.
A white woman’s emotional well being was more valued than that of a dying black man. That delay just may have killed him.
Fun fact, Perotta recently took the fifth when asked if she created a fake profile to harrass members of the public.

I will not engage in the narrative of the Best treatment by the EMT. Although, while I wasn’t there to see if the EMT dropped everything to treat that cop’s panic attack. There had to be a lot of moving parts for some shit like that.

Here’s another thing. Do you know why the Port has fewer shootings and deaths? The same reason you have fewer black Americans in police shooting deaths. They are not getting away with it as they use to.
The Port didn’t have 50 murders a year because the criminals were smarter. They were just getting away with it. Due to policing that really didn’t “care”, in some sense.

That being said, I will stand by my assessment. While Best did get shot in the back, Pencil Box. That cop was not chasing him with his gun in hand, and only after Best moved his hand backwards in a very unnatural way when running from somebody who pointed an object.
While he had several objects in his hands before the chase, I don’t believe a gun was planted. No real reason to run from the cops with out have some thing that would get you busted.
