Supremes Take No Action, Tuesday’s Vote On, Weighing Primary Appeal Under Advisement

The Connecticut Supreme Court on Monday, after hearing oral arguments, took no formal action in the appeal challenging the results of the September 10 Democratic primary in which Superior Court Judge Barry Stevens ruled against the plaintiffs.

This means Tuesday’s vote is on for the general election. Chief Justice Richard Robinson at 4:30 p.m. read the justices decision into the record from the bench. Robinson announced after reviewing briefs and hearing oral arguments that the Supreme Court will take the case under advisement. So a decision will come down the road.

Polls will be open from 6 a.m. to 8 p.m. on Tuesday.

Prerna Rao, attorney for the plaintiffs, urged the court to stop Tuesday’s vote and order a new primary. Appellate specialist James Healy, on behalf of the defense, asserted that Judge Stevens ruling should be upheld arguing the plaintiffs did not meet the burden that the irregularities cited in their lawsuit altered the results of the primary in which incumbent Joe Ganim defeated Marilyn Moore by 270 votes.
